1. Acceptance of Terms

By accessing or using Spectrum AI Coach (the "Service"), operated by Spectrum Assessments International ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. AI DISCLAIMER - IMPORTANT

PLEASE READ THIS SECTION CAREFULLY:

  • AI-generated interpretations and analyses may contain errors. The AI system, while trained on comprehensive Spectrum Assessments materials, may produce inaccurate, incomplete, or misleading information.
  • Users are responsible for reviewing and verifying all AI-generated materials for accuracy before professional use. Do not rely solely on AI outputs for critical decisions.
  • Users must proof all outputs before using them with clients or making professional decisions. AI analysis is a tool to assist, not replace, professional judgment.
  • Any errors or inaccuracies should be reported to Spectrum Assessments International at [email protected].

3. LIABILITY RELEASE AND DISCLAIMER

BY USING THIS SERVICE, YOU ACKNOWLEDGE AND AGREE:

  • The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.
  • Spectrum Assessments International DISCLAIMS ALL WARRANTIES, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Spectrum Assessments International shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:
    • The accuracy or completeness of AI-generated content
    • Professional decisions made based on AI analysis
    • Use or inability to use the Service
    • Any errors or omissions in the Service
    • Any unauthorized access to or alteration of your data
  • YOU ASSUME ALL RISK associated with the use of AI-generated analyses and recommendations.
  • In no event shall Company's total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

4. Service Description

Spectrum AI Coach provides AI-powered analysis of Spectrum Assessments International reports, including but not limited to DISC Behavioral assessments, Motivating Factors, Emotional-Social Intelligence, Career Interests, and Axiology reports. The Service generates coaching plans, team analyses, candidate comparisons, and other insights based on uploaded assessment reports.

5. Acceptable Use

You agree to:

  • Only upload authentic Spectrum Assessments International reports
  • Not attempt to reverse engineer, copy, or extract AI training data
  • Not use the Service for any illegal or unauthorized purpose
  • Maintain confidentiality of assessment reports uploaded to the platform
  • Not share your account credentials with others
  • Report any security vulnerabilities or bugs to us immediately

6. Data Privacy and Confidentiality

We take data security seriously. Uploaded assessment reports and generated analyses are encrypted and stored securely. We do not share your data with third parties except as necessary to provide the Service. You retain ownership of your uploaded reports and generated analyses.

7. Intellectual Property

All Spectrum Assessments content, training materials, methodologies, and AI models are proprietary to Spectrum Assessments International. You may not copy, distribute, or create derivative works based on our proprietary content. Generated analyses are provided for your personal or professional use with your clients.

8. Subscription and Payment

  • Free trial period is 30 days from registration
  • Subscriptions auto-renew unless cancelled
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods
  • We reserve the right to modify pricing with 30 days notice

9. Account Termination

We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion. Upon termination, your data will be retained for 30 days before permanent deletion, allowing you to export your analyses.

10. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state where Spectrum Assessments International is headquartered.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
